PAY-AS-YOU-GO HOUSE & PET SITTING AGREEMENT

(In accordance with South African Law & POPI Act Compliance)

This Pay-As-You-Go House & Pet Sitting Agreement ("Agreement") is made and entered into between:

1. Parties

1.1 Homeowner: The undersigned party utilizing house and pet sitting services ("Homeowner").

1.2 Service Provider: BodyBack (Pty) Ltd, trading as "Home Grannies", a company duly registered in South Africa ("Service Provider").

2. APPOINTMENT

2.1 The Homeowner appoints Home Grannies to provide house and pet sitting services at the Homeowner's residence in accordance with the terms of this Agreement.

2.2 The Homeowner agrees to provide accurate and complete information about their home, pets, and any specific instructions necessary for proper care.

3. AGREEMENT TERMS AND CONDITIONS

3.1 Pay-As-You-Go: This Agreement is ongoing until officially terminated in writing and automatically renews based on the Homeowner's use of services.

3.2 Renewal: The Agreement remains in force as long as the Homeowner continues using the services.

3.3 Payment: The Homeowner shall make timely payments as per Home Grannies’ pricing structure.

3.4 Service Fee: Fees apply per house and pet sitting period.

3.5 Effective Date: The Agreement takes effect upon the Homeowner’s acceptance and signature.

3.6 Fee Changes: Home Grannies may revise fees with reasonable notice to the Homeowner.

3.7 House Rules: The Homeowner agrees to provide a written list of house rules, including pet care instructions, alarm codes, and emergency contact details.

4. SITTING SCHEDULE AND SERVICES

4.1 Scheduling: Home Grannies will allocate house and pet sitters based on the Homeowner’s request.

4.2 Duration: Services cover the dates and times agreed upon.

4.3 Schedule Changes: The Homeowner may request schedule adjustments with prior notice.

4.4 Public Holidays: Services are available on public holidays, but premium rates may apply.

4.5 Pet Care: Home Grannies will ensure adequate pet care during the sitting period, including feeding, exercise, and administering medication as required.

4.6 Home Security: Home Grannies will take reasonable precautions for the Homeowner’s security, but all valuables should be secured by the Homeowner.

4.7 Damages: Normal wear and tear is expected (e.g., broken dishes, minor damages). Any significant damage caused by negligence must be reported immediately, and Home Grannies shall not be held liable.

5. INVOICING AND PAYMENTS

5.1 Invoicing: Home Grannies will issue invoices before each sitting period.

5.2 Payment Due: Payments are due within 7 days of invoicing and before each sitting period.

5.3 Payment Method: Payments shall be made via direct deposit, EFT, or an online secure portal.

5.4 Payment Confirmation: The Homeowner must provide proof of payment to Home Grannies.

5.5 Late Payments: Failure to make timely payments may result in suspension of services and additional penalty fees.

6. SITTER ASSIGNMENT & REPLACEMENT

6.1 Allocation: Home Grannies reserves the right to assign different sitters.

6.2 Replacement: In case of unavailability, a replacement sitter will be arranged in consultation with the Homeowner.

6.3 Background Checks: Home Grannies ensures all sitters undergo background checks and training for service quality and security.

7. BOOKING CHANGES & RESCHEDULING

7.1 Rescheduling: The Homeowner may reschedule services with prior notice.

7.2 Late Changes: Failure to reschedule at least 24 hours in advance results in forfeited service fees.

7.3 Emergency Cancellations: In cases of emergency, Home Grannies may waive cancellation fees at their discretion.

8. TERMINATION OF AGREEMENT

8.1 Cancellation: The Homeowner may terminate the Agreement with written notice, subject to a 24-month survival clause on liability provisions.

8.2 Unused Services: No refunds for unused prepaid services.

8.3 Breach of Terms: If either party breaches the terms of this Agreement, the non-breaching party may terminate the Agreement immediately.

9. LIABILITY & INDEMNITY

9.1 Limitation of Liability: Home Grannies shall not be liable for damages, losses, or injuries incurred by the Homeowner, their property, pets, or sitters, arising from or during services provided.

9.2 Homeowner Indemnification: The Homeowner indemnifies Home Grannies, its affiliates, sitters, employees, shareholders, and directors against any claims, losses, expenses, or liabilities, including legal costs, related to service provision.

9.3 Assumption of Risk: The Homeowner assumes all risks associated with house and pet sitting and acknowledges that valuables have been removed or locked away.

9.4 Emergency Situations: Home Grannies is authorized to seek veterinary or emergency home repairs in critical situations, with costs borne by the Homeowner.

10. NON-SOLICITATION & SITTER RESTRAINT

10.1 Non-Solicitation: The Homeowner shall not directly engage Home Grannies' sitters outside the scope of this Agreement.

10.2 Breach Consequences: Violation of this clause will be deemed a material breach, entitling Home Grannies to seek damages.

11. DISCLOSURE & PROCESSING OF PERSONAL INFORMATION

11.1 Compliance with POPIA: The Homeowner consents to the lawful collection, processing, and storage of personal information for the purpose of fulfilling this Agreement, as per the Protection of Personal Information Act (POPIA).

11.2 Data Security: Home Grannies shall implement reasonable measures to safeguard the Homeowner’s personal information.

11.3 Data Sharing: Personal information may only be shared with authorized employees or third parties involved in service provision.

12. GENERAL DISCLAIMER

12.1 No Guaranteed Results: Home Grannies makes no specific guarantees regarding the quality or outcomes of services provided.

12.2 Policy Amendments: Home Grannies reserves the right to amend this Agreement, with reasonable electronic notice to the Homeowner.

AGREEMENT ACCEPTANCE

By signing below, the Homeowner acknowledges reading, understanding, and agreeing to the terms and conditions of this Agreement.
